Agreement between You (the “Customer”) and Banana Joe Tours

1. Agreement Acceptance: By using Banana Joe Tours, you agree to be legally bound by these terms, which shall take effect immediately.

2. Non-Acceptance: If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use bananajoetours.com.

3. Changes in Terms & Conditions: Banana Joe Tours may change these Terms & Conditions at any time by posting changes online. Your continued use after changes are posted means you agree to be legally bound by these updated terms.

4. Use of Website Content: You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use website content (including text, images, URLs, pricing information, etc.) except for your own personal, non-commercial use. Any other use of content requires the prior written permission of Banana Joe Tours.

5. Lawful Use: You agree to use the website only for lawful purposes, and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment.

6. Purpose of Use: Your use of the website is intended for personal, noncommercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make a speculative, false, or fraudulent request. You agree not to use robots or other automated means to access this site.

7. Amendment and Date Change Policy: Banana Joe Tours allows amendments or date changes to existing bookings if requested more than 48 hours ahead of the confirmed tour date. Special event, theater, or show tickets cannot be modified once purchased. Other changes are subject to availability and may result in a cancellation fee.

8. Cancellation Policy: Cancellation fees may apply as follows:

At least 21 days in advance: No fee. Between 20 and 15 days in advance: 50 percent cancellation fee. Within 14 days or no show: 100 percent cancellation fee. (Note: Attractions, tours, theater, or shows are non-refundable in all circumstances. If the show is canceled by the box office, the ticket price will be refunded.)

9. Responsibility for Cancellations: Banana Joe Tours is not responsible for any other arrangements affected due to cancellations, whether initiated by the Customer or by Banana Joe Tours.

10. Supplier Changes: Suppliers may make changes to tour prices, inclusions, etc., allowing Banana Joe Tours to cancel, change, or substitute any service, tour, ticket, or product you have booked at any time, for any reason.

11. Pricing: Prices listed on the website are per person unless otherwise specified and are based on United States currency. Price quotations are subject to change until a booking has been confirmed.

12. Payment: There is a charge for processing credit card payments. Full payment by credit card is required to make a reservation.

13. No Refunds: No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals, or any other services utilized.

14. Voucher Requirement: You will receive a voucher for each tour, event, or service booked. The original, authentic voucher must be provided to the appropriate service provider for redemption. Presentation of a valid photo ID and signature may be required for security and fraud prevention.

15. Liability Limitation: Banana Joe Tours is not liable for various losses or damages, including indirect, consequential, special, or exemplary damages.

16. Unforeseen Circumstances: Banana Joe Tours accepts no responsibility for sickness, pilferage, machinery breakdown, acts of war and/or terrorism, weather conditions, or other causes beyond their control.

17. Content Disclaimer: Information, names, images, pictures, logos, prices, dates, and availability regarding or relating to Banana Joe Tours and service providers are provided “AS IS” and “AS AVAILABLE.”

18. Website Functionality: Banana Joe Tours does not guarantee uninterrupted, error-free website functionality.

19. Tour Duration and Punctuality: Duration of tour/activity hours is approximate and can change due to pick-up routes or location changes. Customer parties should be ready 10 minutes before pick-up time. Banana Joe Tours does not guarantee on-time arrival in case of bad weather, traffic conditions, or other uncontrollable circumstances.

20. Risk Acknowledgment: Tours/activities may carry some risk, and Banana Joe Tours assumes no liability for injuries.

21. No Smoking: No smoking is allowed in tour/activity vehicles or aircraft.

22. Tour Guide Gratuity: Tour guide gratuity is at the customer’s discretion and is not included.

23. Tour Alterations: Banana Joe Tours reserves the right to alter, modify, or cancel tours/activities due to various reasons, including traffic, bad weather, or safety concerns.

24. Tour Content and Prices: Banana Joe Tours reserves the right to cancel or change tour/activity content and prices without prior notice. Tour/activity routes and content are subject to change without notice.

25. Inclusions: Only items stated on the website brochure page are included in the tour/activity. Any other items are additional and not included, such as meals unless specifically mentioned.

26. Delays and Lost Articles: Banana Joe Tours is not responsible for delays or service interruptions due to mechanical failure, accidents, or other circumstances beyond their control. Lost or stolen articles left on board any form of transportation used on the tour/activity are not the responsibility of Banana Joe Tours.

27. Ticket Validity: Tickets shall be null and void and of no value unless utilized by the customer on the date and time on the tickets.

28. Credit Vouchers: In some circumstances, a credit voucher may be offered to a customer. Credit vouchers are subject to terms and conditions, and their acceptance may render disputes void. A credit voucher may be redeemed for one or more specific reservations only once.

29. Availability: Lodging, show, attraction, and other reservations are subject to availability.

30. Product Accuracy: Banana Joe Tours does not guarantee product accuracy, and in case of inaccuracies, may refund payments or offer the correct product at the correct price.

31. Management Rights: To the extent permitted by law, the management reserves the right to revoke the rights granted and refund the purchase price of the ticket.

32. Massive Bookings: For tours arranged through cruise ship bookings and port pickups, should there be a substantial number of reservations, we may opt to utilize larger vehicles such as motorcoaches and other vehicles tailored to accommodate larger groups.

In the usual course of our meticulously curated tours designed for small groups and individuals, transportation primarily involves vans and mini-buses; however, in instances where specific language guides are requested for larger groups, including amalgamations of smaller individually booked groups, a larger bus may be allocated due to the limited availability of specialized guides in the requested languages such as German, English, Russian, French, Italian, or any other language for which we offer our tours.

33. Final Sales: All tour sales are final and non-refundable.

34. Vehicle Variations: Different vehicles than those displayed in images on the Banana Joe Tours website may be used for tours.

35. Photography/Video Release: Banana Joe Tours may make photographs or video recordings during sightseeing tours for promotional or marketing purposes. Customers are released from all liability arising out of the use of these recordings.

We pick up in private residences or Hotels ONLY in our pick-up area, please note that pick-up times are depending on your location and other factors. The guides will send out the pickup times the afternoon before the tour via email. 

Certain addresses in Miami Beach are ineligible for direct pickup due to local code restrictions. In such cases, we will arrange for the nearest available pickup point to ensure smooth service.

Unpredictable weather is a regular occurrence, with fluctuations observed every other day. Tours will operate in rain or shine.

 Tour & Travel Insurance can be booked separately, with prices quoted on request.

Banana Joe Tours reserves the right to change this Policy at any time, with amendments becoming effective upon posting on this website. Significant changes will be communicated via email. Continued use of our services signifies acceptance of any amended policy.
